This Privacy Policy explains how Cre8tive Change, LLC (“we,” “us,” “our,” or “Amalynk”) collects, uses, shares, and protects your personal information when you use our AI-powered family support platform (“Service”). By accessing or using the Service, you agree to the practices described in this Policy.

1. Electronic Records & Signature Consent

By using the Service, you consent to receive all notices electronically, including updates to this Privacy Policy. You acknowledge that your use of the Service constitutes acceptance of this Policy, and that electronic acceptance has the same legal effect as a handwritten signature.

2. Definitions

For purposes of this Policy and any related agreements governing the use of the Amalynk platform (the “Service”), the following terms have the meanings set forth below. Capitalized terms used but not defined herein shall have the meanings provided in the Terms of Service.

(a) “Account” Means the unique profile created by a User to access the Service, including any associated credentials, preferences, communications, or profile information.

(b) “Affiliate” Means any entity that controls, is controlled by, or is under common control with Cre8tive Change, LLC.

(c) “AI Tools” or “Automated Decision-Making Tools” Means machine learning, natural language processing, or other automated systems used to assist with matching, safety review, content moderation, or referral recommendations.

(d) “Applicable Law” Means all federal, state, local, and international laws, regulations, and standards governing privacy, data protection, digital communications, and electronic signatures, including but not limited to GDPR, CCPA/CPRA, FERPA, HIPAA (if applicable), and the U.S. E-SIGN Act.

(e) “Community Guidelines” Means the behavioral standards, conduct rules, cultural expectations, and safety norms applicable to all Users of the Service.

(f) “Content” Means any text, messages, images, data, audio, video, posts, or other materials submitted, uploaded, transmitted, or displayed on or through the Service by a User.

(g) “Cre8tive Change,” “we,” “us,” or “our” Means Cre8tive Change, LLC, the owner and operator of the Amalynk platform.

(h) “Data Controller” (or “Controller”) Means the entity that determines the purposes and means of processing personal information. For Users of the Service, Cre8tive Change, LLC is the Controller unless otherwise stated.

(i) “Device Information” Means information automatically collected from a User’s device, including IP address, browser type, operating system, app version, and security identifiers.

(j) “Electronic Communications” Means any communications provided by us electronically, including emails, text messages, in-app notifications, push notifications, or electronic delivery of disclosures, updates, or legal notices.

(k) “Electronic Signature” Means an electronic sound, symbol, click, tap, or other process attached to or logically associated with a record and executed with the intent to sign that record, consistent with the E-SIGN Act.

(l) “Helper” Means a User who provides or offers assistance, support, or guidance to families or organizations through the Service, whether formally trained or acting as a community member.

(m) “Licensed Professional” Means a Helper or User who holds a professional license (e.g., clinical, medical, social work, legal, educational) and who participates within the Service subject to applicable professional standards.

(n) “Organization” or “Organizational User” Means schools, nonprofits, agencies, community partners, or other entities that create accounts for staff or delegates to engage with the Service. Actions of staff members are attributable to the Organization.

(o) “Personal Information” or “Personal Data” Means any information that identifies, relates to, describes, or can reasonably be linked to an individual, household, or device, including name, contact information, message content, demographic data, and usage information.

(p) “Processing” or “Process” Means any operation performed on Personal Information, whether automated or manual, including collection, storage, use, disclosure, analysis, modification, or deletion.

(q) “Safety Review” Means review of Content or activity by Cre8tive Change, its systems, or AI Tools for the purpose of detecting possible harm, abuse, misconduct, or policy violations.

(r) “Service” Means the Amalynk mobile application, website, platform, communication tools, AI systems, and all related services operated by Cre8tive Change, LLC.

(s) “Third-Party Service Provider” Means any vendor, contractor, cloud provider, analytics provider, communication partner, identity verification service, or other entity engaged by Cre8tive Change to support the operation, maintenance, or improvement of the Service.

(t) “User,” “you,” or “your” Means any individual or entity that creates an account, accesses, uses, or interacts with the Service in any capacity, including Helpers, Families, Professionals, and Organizational Users.

6. How Our AI Works

Amalynk uses artificial intelligence to:

  • Recommend potential helpers or resources
  • Identify concerning content
  • Improve matching and response times

AI tools assist our operations but do not replace human judgment. Users have the right to request human review of decisions that significantly affect them.

Automated systems may evaluate message content, matching suitability, or safety indicators. Automated tools may temporarily restrict access pending human review. Users may request an explanation or challenge an automated action.

7. Legal Bases for Processing

Depending on your jurisdiction, we may process your information based on:

  • Consent (e.g., creating an account, sharing information with helpers)
  • Contract (to provide the Service you requested)
  • Legitimate Interests (safety, fraud prevention, platform improvement)
  • Legal Obligations (mandatory reporting, compliance requirements)

8. Information Sharing

8.1 With Verified Community Helpers

To facilitate support, we share only the information needed for helpers to assist you.

8.2 With Service Providers & Vendors

We do not sell your personal information. Service providers may include hosting providers, identity verification vendors, analytics platforms, fraud detection tools, and communication partners. We require all service providers to maintain security comparable to our own. However, Amalynk is not liable for the acts or omissions of third-party vendors beyond our contractual rights of enforcement.

8.3 For Emergency or Safety Purposes

We may disclose information to:

  • Law enforcement
  • Child protective authorities
  • Emergency responders

when required to protect users or comply with the law.

8.4 Legal Compliance

We may share information to:

  • Respond to legal requests
  • Enforce our Terms of Service
  • Protect our rights or users’ safety

9. Third-Party Links & External Tools

The Service may link to third-party resources. We are not responsible for their privacy practices, content, or security.

10. Cross-Border Data Transfers

Your information may be processed on servers located in the United States. When required, we use contractual safeguards to ensure your information is protected.

11. Data Security

We use industry-standard security measures, including:

  • Role-based access controls
  • Regular security audits

However, no system is 100% secure, and we cannot guarantee absolute protection.

12. Data Retention

  • Active account data: retained while your account is active
  • Help request history: retained for five (5) years for safety and dispute resolution
  • Message logs: retained for one (1) year to support safety audits, user inquiries, and abuse investigations consistent with industry standards.
  • Deleted account data: permanently removed within thirty (30) days

Retention periods consider safety concerns, operational needs, and legal requirements. We retain information only as long as needed to provide the Service or meet legal obligations. If your account or data is subject to a legal hold, investigation, or request from law enforcement, we may retain certain information beyond normal retention periods.

13. Your Privacy Rights

Depending on your location, you may have the right to:

14. Children’s Privacy

The Service is intended for users eighteen (18) and older. We do not knowingly collect personal information from children under thirteen (13). If such information is discovered, we will delete it promptly.

  • Avoid posting confidential data unnecessarily
  • Report safety concerns or misuse immediately

You agree to provide accurate information and to update it when changes occur. We are not responsible for issues arising from inaccurate or outdated data provided by users.

16. Your Device & Internet Security Responsibilities

You are responsible for maintaining the security of the devices and internet connections you use to access the Service. We are not responsible for breaches or data exposure resulting from malware, insecure networks, outdated software, or compromised devices.

17. Fraud & Misuse Reporting

Users must notify us immediately at privacy@amalynk.com if they suspect unauthorized access, misuse of their account, or compromise of personal information. Failure to report suspected misuse in a timely manner may limit our ability to assist.

18. Changes to This Privacy Policy

We may update this Policy periodically.

For significant changes, we will provide:

Continued use of the Service after changes take effect constitutes acceptance.
